Terms of Service
This English text is a reference translation. In the event of any conflict, the Korean version shall prevail.
Article 1 (Purpose)
These Terms govern the conditions and procedures for using the website and mobile applications (collectively, the "Service") operated by Divult (the "Company"), and define the rights, obligations, and responsibilities of members and the Company.
Article 2 (Definitions)
- Member: a person who agrees to these Terms and registers for and uses the Service.
- Digital Twin: a digital asset representation corresponding to a single physical trading card that a member has stored and registered.
- Cash: a rechargeable value used for payment and trading within the Service; cash refunds are subject to Company policy.
- Reward Point: credit granted by the Company free of charge; it is not refundable or convertible to cash.
- Auction: trading of a Twin via English-style bidding.
- Partner: a member registered as a seller/business after a separate review.
Article 3 (Effect and Amendment of Terms)
- These Terms take effect upon being posted on the Service screen.
- The Company may amend these Terms within the scope of applicable laws. When amending, the Company will specify the effective date and reason and give notice at least 7 days before the effective date. For changes that are disadvantageous or material to members, notice and individual notification will be given at least 30 days in advance.
- A member who does not agree to the amended Terms may request withdrawal. Continued use of the Service after the effective date is deemed acceptance of the amended Terms.
Article 4 (Membership Registration)
- An applicant provides information in the form prescribed by the Company after agreeing to these Terms and the Privacy Policy.
- The Company may refuse registration or terminate it afterward in any of the following cases:
- using another person's name or information without authorization;
- entering false information;
- being under 14 years of age, or a minor without the consent of a legal representative;
- re-registering after a prior use contract was terminated for violation of these Terms.
Article 5 (Provision of Service)
- The Company provides the following services:
- intake of physical cards and issuance of Digital Twins;
- Instant trading, auctions, and Swap;
- physical withdrawal (shipout) requests;
- add-on services such as membership, referrals, and leaderboards.
- The Company may temporarily suspend the Service for unavoidable reasons such as system maintenance, force majeure, or third-party service failures, in which case it will give notice before or after the fact.
Article 6 (Cash and Points)
- Members charge Cash via a payment method; charged Cash is valid for 5 years from the payment date.
- The Company records all Cash and Point movements through a double-entry ledger, and balance change history can be viewed on My Page.
- Reward Points are granted under policies set by the Company (signup, events, cashback, etc.) and are not subject to refund or conversion to cash. Points are valid for 1 year from the grant date; any change will be announced in advance.
- If Cash is deducted due to reasons attributable to the Company and not the member, the Company will immediately restore the same amount.
Article 7 (Digital Twins and Physical Storage)
- When a member deposits a physical card at a storage facility designated by the Company, the Company stores the card and issues a Digital Twin to the member.
- Ownership of a Digital Twin belongs to the registering member; upon a Twin trade, ownership transfers separately from physical possession.
- Members may receive their physical card via a withdrawal request, subject to fees and shipping costs set by the Company.
- The Company is not responsible for ordinary wear during storage, but will compensate for loss caused by the Company's willful misconduct or gross negligence based on market value or by replacement with an equivalent card.
Article 8 (Trading, Auctions)
- Auction bidding is English-style; cancellation after bidding is allowed only as provided by Company policy.
- The Company applies concurrency control to ensure the integrity of simultaneous resource allocation and to prevent duplicate allocation.
Article 9 (Member Obligations)
- Members must not engage in the following:
- misappropriating another person's information or transferring an account;
- depositing forged/altered cards or registering cards without rights;
- automated/repeated transactions exploiting system vulnerabilities, or price manipulation;
- wash trading or money laundering disguised as cash payment;
- infringing third-party rights such as copyrights or trademarks;
- acts in violation of applicable laws or these Terms.
- Upon violation, the Company may, without prior notice, hold transactions, freeze balances, suspend use, or terminate the account.
Article 10 (Fees)
The Company charges certain fees for trading, withdrawal, auctions, and the like; fee rates and membership-tier differences are described on a separate page. Fee changes are announced 7 days before the effective date.
Article 11 (Intellectual Property)
- Copyright in Service content (design, logos, text, code, UI) belongs to the Company or the rightful owner.
- Copyright in content registered by a member, such as card images, belongs to the member; the Company may use it non-exclusively and free of charge solely for Service operation and promotion.
- IP names such as Pokémon, One Piece, Yu-Gi-Oh!, and Magic: The Gathering are assets of their respective owners; this Service is a secondary distribution platform unaffiliated with those owners.
Article 12 (Termination and Refunds)
- Where a refund is required due to reasons attributable to the Company (system error, probability discrepancy, confirmation of a counterfeit card, etc.), the details follow the Refund Policy.
- If an account is terminated for a violation of Article 9, unsettled Cash is refunded after the dispute concludes.
Article 13 (Limitation of Liability)
- The Company is not liable for damages caused by force majeure such as natural disasters, power outages, network failures, or third-party service failures.
- The Company does not directly intervene in disputes arising between members or between a member and a third party; however, it is liable for damages caused by a defect in the escrow process it provides.
- The Company is not liable for account theft or password loss caused by the member.
Article 14 (Governing Law and Jurisdiction)
These Terms are governed by the laws of the Republic of Korea, and the Seoul Central District Court shall be the court of first instance for any dispute.
